1. Who we are

Aniday is a trading name of the business registered with the Dutch Chamber of Commerce under number 55982638 and based in Nijmegen, the Netherlands. You can contact us at info@aniday.io.

2. When these terms apply

These terms apply to every business offer, trial, agreement and use of Aniday. Aniday is intended for businesses and organisations. A different arrangement only applies when confirmed in writing.

If documents conflict, a signed agreement or order confirmation takes precedence over these terms. Customer terms only apply when Aniday has accepted them in writing.

3. Account and agreement

The agreement starts when you accept an offer, choose a paid subscription or Aniday confirms your order in writing. You provide accurate and current business and contact details.

You are responsible for users you grant access to, for keeping login details confidential and for activity within your account. Report suspected misuse or unauthorised access immediately at info@aniday.io.

4. Trial period

A standard trial lasts 14 days. For a specific promotion, Aniday may offer a 30 day trial or another period in writing. The trial is free unless a different arrangement is made clear in advance.

A trial account does not automatically become a paid subscription unless you choose a plan or accept an offer. Features, storage or support may be more limited during a trial.

5. The service

Aniday provides online software for areas including scheduling, bookings, customer and animal records, communication, payments and administration. The features available to you depend on your plan, enabled modules and any additional arrangements.

We use reasonable efforts to keep Aniday available and operating with care. Maintenance, security measures, incidents or dependencies on external services may cause temporary interruptions. A specific availability level only applies if agreed separately.

We may change the service to improve it, keep it secure, comply with the law or prevent misuse. We will notify you in advance of a material adverse change where reasonably possible.

6. Acceptable use

You may use Aniday only for lawful business purposes and in line with the instructions in the software. You must not bypass security, disrupt the service, introduce harmful code or give access to unauthorised parties.

You are responsible for the accuracy and lawfulness of the data you enter and for the communication, prices, terms and choices you offer your customers through Aniday.

7. Prices and payment

Aniday offers monthly and annual subscriptions. The price, billing period, modules and start date are shown in the selected plan, offer or order confirmation. Business prices exclude VAT unless explicitly stated otherwise.

Invoices must be paid within 14 calendar days of the invoice date unless the invoice or agreement states a different period. You must maintain a valid payment method and provide changes in time.

If payment is late, we may charge statutory commercial interest and reasonable collection costs after a reminder. We may restrict access while an amount due remains unpaid. This does not remove your payment obligation.

We announce price increases for active subscriptions in advance, including the new price and effective date. A change takes effect at renewal. An annual period paid in advance will not become more expensive during that period. Different pricing arrangements confirmed in writing take precedence.

We increase the subscription price once per calendar year by a fixed rate of 2.5%. This applies to Essentials and Pro from 2027. Business will first be indexed in 2028. We calculate the increase on the subscription price in effect at that time, excluding VAT, and round the new invoice amount to the nearest euro cent. This is a fixed annual increase, not a rate linked to an inflation index.

For monthly billing, the indexed price applies from the first monthly renewal on or after 1 January. For annual billing, it applies from the first annual renewal on or after 1 January. The new Business prices apply to existing monthly subscriptions from 1 January 2027 and to existing annual subscriptions at the first annual renewal on or after that date. Business will not receive an additional indexation increase in 2027.

8. Data and privacy

You remain responsible for the content of data you place in Aniday. For personal data relating to your customers, staff and animal contacts, you are generally the controller and Aniday acts as processor.

Where required by the GDPR, the parties will record processing arrangements in a data processing agreement. You authorise Aniday to process data to provide, secure and support the service and to use carefully selected subprocessors for those purposes.

9. Security and confidentiality

Both parties handle confidential business information and personal data with care and share it only with people who need it for their work. This obligation continues after the agreement ends.

Aniday takes appropriate technical and organisational measures that reflect the risks of the service. No online service is completely risk free. You remain responsible for secure devices, your own access controls and timely exports needed for your operations.

10. Intellectual property

All rights in Aniday, the software, documentation, designs and improvements remain with Aniday or its licensors. During the agreement, you receive a limited, non-exclusive and non-transferable right to use the service within your own organisation.

You retain the rights in your own content. You grant Aniday only the rights needed to store, display, secure, export and otherwise process that content for you under the agreement.

11. Third party services and integrations

Aniday may connect to services for payments, email, accounting, support or other features. Use of such a third party service may be subject to that provider’s terms and privacy policy.

We are not responsible for an outage or change at a third party service outside our reasonable control. We will provide reasonable assistance when investigating issues with a supported integration.

12. Term and cancellation

A monthly subscription can be cancelled monthly. An annual subscription runs for the agreed annual period and is billed in advance. You can cancel through the account area or at info@aniday.io. We will confirm the end date.

A cancellation prevents the next renewal if it is processed before the renewal date. Amounts already paid are not refunded unless required by law or agreed otherwise in writing.

Export any data you wish to keep before access ends. After termination, we may delete data in line with the agreement, privacy notice, legal retention duties and our normal backup cycle.

13. Suspension and termination

Aniday may temporarily restrict access in the event of a serious security risk, suspected misuse, a legal obligation or overdue payment. Where the situation allows, we will notify you in advance and give you a reasonable opportunity to resolve the issue.

Either party may terminate the agreement for a material breach that is not remedied within a reasonable period, or immediately in the event of bankruptcy, cessation of business or another situation that makes performance permanently impossible.

14. Liability

Aniday is liable only for direct loss caused directly by an attributable failure. Liability for indirect loss, lost revenue, lost savings, loss of goodwill and business interruption is excluded to the extent permitted by law.

Aniday’s total liability per event and per calendar year is limited to the amount you paid for the relevant service in the six months before the loss. This limitation does not apply in the event of intent or deliberate recklessness by Aniday’s management.

A limitation does not apply to the extent it is not permitted under mandatory law. You must report loss as soon as possible and provide the information reasonably needed for Aniday to investigate its cause and extent.

15. Force majeure

A party is not liable for delay or failure caused by circumstances outside its reasonable control. These may include outages at hosting or network providers, power failures, cyberattacks, government measures, natural disasters and widespread internet outages. The affected party will reasonably limit the impact and resume performance as soon as possible.

16. Changes to these terms

We may update these terms when the service, our practices or the law changes. We will notify active customers in advance of a material change. The new version applies from its stated effective date. If you cannot agree to a material adverse change, you may cancel before that date.

17. Law and contact

The agreement is governed by Dutch law. The parties will first try to resolve a dispute together. If that is not possible, the dispute will be submitted to the competent court in the district where Aniday is based, unless mandatory law requires another court.
